1.b. Visitor - A person who visits our website.

1.c. Services - Our offered services that are available for registration/purchase through our website and social media pages.

1.d. Privacy Policy - This Privacy Policy that details the procedure for the collection, storage and use of user data.

1.e. Personal Data - Personally identifying information about an individual (either by itself or when put together with other information).

1.f. Lead Form Our registration form that we offer users to fill in via our LinkedIn and Instagram pages.

2. Edustudies Centre as a data controller

2.a. Whenever Edustudies Centre collects, uses or transfers your Personal Data for its own purposes, Edustudies Centre acts as the data controller of your Personal Data. 3.a. User data is collected, stored and processed in accordance with this Privacy Policy, the EU General Data Protection Regulation (GDPR) 2016, the Law on Legal Protection of Personal Data of the Republic of Lithuania, the Data Protection Act 2018 of the Republic of Ireland, as well as other applicable legal acts.

3.b. Edustudies Centre, an informal education provider, takes appropriate technical and organisational measures to ensure the protection of all processed Personal Data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access and against all other forms of unlawful processing.

3.c. By agreeing to this Privacy Policy, the Visitor agrees that Edustudies Centre will manage the data provided during the user registration (name, surname, email address, phone number, bank payment card data, as well as feedback provided by the user) and will process for the purposes described in this Privacy Policy and legal acts. The user's consent, expressed by submitting Personal Data, is the legal basis for the collection and processing of this data.

3.d. We use and process user Personal Data (name, surname, email address) for direct marketing purposes on the basis of the user's consent, which is expressed when the user fills out forms on our Website.

3.e. This Privacy Policy applies in all cases when the user registers on the Website and submits or corrects any personal data specified in clauses 3.c. - 3.d. of this Privacy Policy, regardless of whether the user has been provided with Services, as well as when the user provides any other personal information on the Website (feedback, enquiry etc.).

4.a.(i). Edustudies Centre collects your Personal Data from your use of the Website (i.e. visiting the Website pages, the blog, downloading resources and viewing infographics on the Website), from your subscription to any of our emailing lists, from any request you send through the website (e.g. registering for our Services via our registration form), when you attend a webinar or participate in an online survey and provide your Personal Data to us. 

4.a.(ii). Personal information: When you register for our Services, we collect Personal Data such as your name, email address, phone number, email address, and payment information. 


4.a.(iii). Student information: If you are a student, we may collect data such as your grade level/class, subject(s) you need to avail of our Services in, any additional details about the nature of your Services request, your academic performance, your academic goals, your learning style(s) and your learning strengths/weaknesses.

4.a.(iv). Tutor information: If you are a tutor, we may collect information such as your qualifications, certifications, teaching experience, and availability.

4.a.(v). Usage information: We may collect information about how you use our website and Services, including your session duration, interactions with our Website, the date and time you accessed our Website, region/country, language and if you send a request through a form provided via our Website.

 

4.b. Social Media

4.b.(i). Edustudies Centre collects your Personal Data via your submission of our Lead Forms and your use of our social media pages. From your subscription to any of our emailing lists, when you express your interest in attending one of our webinars and when you participate in an online survey or polls.

4.b.(ii). Personal information: When you register using our Lead Form, we collect Personal Data such as your name, email address, phone number and email address.

4.b.(iii). Student information: If you are a student, we may collect data via our Lead Form such as your grade level/class, subject(s) you need to avail of our Services in and any additional details about the nature of your Services request.

5.a.(i). To provide Services: We use the information we collect to deliver our Services, match students with tutors, schedule sessions, process payments, and communicate with users about their tutoring needs.

5.a.(ii). Analytics: We may analyse usage data to improve our Website and its features, to better understand how you use the Website and to improve our Services.

5.a.(iii). Personalisation: We may use your information to personalise your experience with us, such as recommending tutors or study materials based on your preferences and academic goals.

5.a.(iv). Marketing: With your consent, we may use your information to send promotional emails, newsletters, or other marketing communications about our Services and special offers.

5.a.(v). Legal Obligations: Edustudies Centre uses your Personal Data for compliance with legal obligations to which we are subject to, including for legal and regulatory compliance, with respect to maintaining business records for reasonable periods as required by applicable tax and other laws.

6.a. Service Providers: We may share your information with third-party service providers who assist us in delivering our tutoring services, such as payment processors and IT providers, such as Wix. We may use cookies from TrustPilot to invite our customers and users to write reviews and verify them.

6.b. Legal Compliance: We may disclose your information if required by law or in response to a valid legal request, such as a subpoena or court order.

6.c. Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred to a third party as part of the transaction.


7. International data transfers

7.a. EU Data Subjects: Edustudies Centre may transfer your data to third-party service providers located outside the European Union (EU).

7.b. To comply with EU data protection laws, including the General Data Protection Regulation (GDPR), all Sim Local data importers outside the EU are obligated to process and protect all personal data received from the EU in accordance with the controller-to-controller standard contractual clauses, as approved by the European Commission in order to protect all personal data received from the EU.

7.c. The transfers of data to third-party service providers are secured by implementing the safeguards required under the applicable data protection law (including contractual arrangements with a third-party service provider).


8. Retention of personal information

8.a. We will retain your personal information for only as long as it may be necessary for the purpose it was collected and no longer than is allowed under the applicable data protection laws. 

8.b. We will retain your Personal Data for a period not exceeding longer than, where applicable.

8.b.(i). The duration of your Services with us.

8.b.(ii). Three years as from the date where such Personal Data was collected or before if you object to the processing of your personal data for marketing purposes.

8.b.(iii). The duration of the applicable statute of limitations.

8.b.(iv).
The duration of the processing of your requests.

9. Rights regarding your Personal Data

9.a. As a data subject, you may have certain rights, including the Right to access

9.a.(i). This constitutes the right to obtain confirmation from Edustudies Centre as to whether any Personal Data concerning you is processed by us.

i). This includes the right to access such Personal Data to obtain a copy of it free of charge (except for repetitive or excessive requests), and to be provided with a description of main features of the processing implemented in relation to your Personal Data.

vi). The right to access the request of rectification or erasure of personal data, as well as the right to object to or request restriction of processing.

9.a.(vii). The right to lodge a complaint with a supervisory authority.

9.a.(viii). The right to access information relating to any third party source of Personal Data if the data were not collected from you.


9.a.(ix). The right to access the existence, the logic involved, the significance and the consequences of any automated decisions, including profiling.

9.a.(x). If you are located in the EU, and your Personal Data is transferred outside of the EU, you have the right to be informed of the appropriate safeguards implemented relating to each transfer.

9.b. The Right to rectification

9.b.(i). The right to erasure: The right to obtain without undue delay the erasure of your Personal Data.

9.b.(ii). The right to erasure, where such Personal Data is no longer necessary in relation to the purpose(s) for which it was collected or otherwise processed.

9.b.(iii). The right to erasure where you withdraw the consent on which the processing was based, and there are no other legal grounds for the processing.

9.b.(iv). The right to erasure where you object to the processing: Either your Personal Data has been unlawfully processed or your Personal Data has to be erased for compliance with a legal obligation.

9.b.(v). Edustudies Centre may refuse such a request, notably when such data is necessary to comply with a legal obligation.

The Right to restriction

9.c.(i). The right to restrict the processing of your Personal Data, where you claim inaccuracy of your Personal Data processed by Edustudies Centre (the restriction being provided for a period allowing us to verify the accuracy).

9.c.(ii). The right to restrict the processing of your Personal Data, where the processing appears unlawful, and you oppose the erasure and request the restriction of use of your Personal Data instead. 

9.c.(iii). The
 right to restrict the processing of your Personal Data, where Edustudies Centre does not need such Personal Data for the purposes of processing, but such Personal Data is required by you for the establishment, exercise or defence of legal claims.

9.c.(iv). The
 right to restrict the processing of your Personal Data, where an objection is raised by you in relation to the processing, pending the verification whether the legitimate grounds of Edustudies Centre override those of you.

9.d. The Right to object

9.d.(i). The right to object, at any time, and on legitimate grounds relating to your specific situation, to the processing of your Personal Data, which includes the processing for marketing purposes, in addition to the profiling relating to such activities.

9.e. The Right to data portability

9.e.(i). The
 right to data portability, where the processing is based on your consent, and where such processing is carried out by automated means.

9.e.(ii). You have the right to request Edustudies Centre to communicate the Personal Data concerning you to you, in a structured, commonly-used and machine-readable format, in order to be able to further transmit such Personal Data to another data controller.

.(iii). You have the right to request Edustudies Centre to directly transmit such Personal Data to another such data controller, if technically feasible.

9.f. The Right to withdraw consent

9.f.(i). The right to withdraw consent, where the processing of your Personal Data is based on consent (subject to applicable legal restrictions) at any time without affecting the lawfulness of processing based on consent prior to its withdrawal.

 right to lodge a complaint with the relevant supervisory authority.

10. Children's privacy

10.a. Our education Services are not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe that we have inadvertently collected information from a child under 13, please contact us immediately.

11.a. We reserve the right to update or revise this Privacy Policy at any time. We will notify you of any changes by posting the updated policy on our Website or by sending you an email, if you have provided this to us.
